Employers are responsible for making the necessary document checks, even if they think a potential worker has the right to work in the UK. It is vital for the employer’s own protection to keep a record and copy of documents that have been checked.

If a company is found to be employing illegal migrant workers and has not established a ‘statutory excuse’, they may have to pay a civil penalty of up to £10,000 per illegal migrant worker*.

There is also the risk of being prosecuted for the offence of knowingly employing an illegal migrant worker. Conviction for this offence can incur an unlimited fine and/or a prison sentence of up to two years.
